Despite the continued strong delivery of its hydrogen fuel cell electric trucks in Q1, ghosts of Nikola’s past continue to haunt the original equipment manufacturer (OEM).
The US-based zero-emission truck OEM continues to engage in a complex legal battle – one with several bizarre aspects to it. The company is suing EMBR Motors Inc. and its co-founders – a firm it partially owns, along with the disgraced ex-chairman and CEO of Nikola Trevor Milton – over allegations of an illegal corporate takeover attempt.
The conflict surfaced again with a March 29, 2024, SEC disclosure. This said that Nikola would pursue legal action against EMBR, its co-founders Dave “Heavy D” Sparks and Cole Cannon, as well as Milton. Sparks, a celebrity mechanic from the Diesel Brothers series, and Cannon, an attorney, alongside Milton, are accused of breaching an agreement ensuring Milton’s non-involvement in EMBR.
